General Information:

Epassi Finland Oy (Business ID 3220764-7), hereinafter referred to as "Epassi", is the owner of this website. These general terms and conditions govern your (“you” or “User”) access and use of the SuperDeals Portal, hereinafter referred to as the “Terms of Use”. User accepts these Terms of Use as a part of their registration process to the SuperDeals Portal and thereby commits to comply with these Terms of Use.

This service is a benefit that has been contracted from Epassi by the Company to which you belong as an employee, associate, client or within a similar role, enabling you to access the SuperDeals Portal. Your access is subject to you being part of the Company. You acknowledge and agree that Epassi and the Company may exchange information concerning you that confirms your eligibility to access the SuperDeals Portal.

Access, registration and use of SuperDeals Portal is voluntary and free of charge for you.

Nature of the Service:

The SuperDeals Portal is available via a mobile application or as a web service. The different usage methods of the SuperDeals Portal may have differing features from each other or its usage possibilities may be limited in relation to another usage method.

As a registered user you will have access to a SuperDeals Portal in which certain services and benefits such as offers and promotions, reward programmes as well as other incentives may be available to you from time to time (hereinafter “Promotions”). The number of Promotions you will have access to may vary depending on your role within the entity and the agreement the Company has with Epassi.

SuperDeals Portal and Epassi will act as a platform for the Promotions and is not to be considered as a seller of any services or products unless otherwise expressly communicated. The seller of the products and services or the provider of the Promotions shall be a third party, whose terms will be applicable to any use of the Promotion or sale of goods. The information provided in the SuperDeals Portal concerning the Promotions may be provided by third party and is provided, to the maximum extent legally possible, “as is”.

User Obligations:

As a registered user you hereby agree to use in good faith and in an appropriate manner the service offered by Epassi, as well as the contents of the SuperDeals Portal and not to use them for illicit activities or activities that may cause harm to any third parties.

No commercial use: The Promotions shown on the SuperDeals Portal are exclusively intended for the SuperDeals Portal users as consumers. Using the Promotions contained by the SuperDeals Portal for commercial purposes is prohibited. This shall include but not be limited to commercially purchasing and/or commercially selling goods and services.

User created content: Users are solely responsible for any content they publish on the SuperDeals Portal. Before uploading any content, the User must ensure they have the necessary permissions and comply with the SuperDeals Portal’s rules and regulations, as well as image rights and intellectual property. Epassi does not assume editorial responsibility and does not endorse user opinions. Users are entirely accountable for the comments they post and commit not to publish illegal, racist, xenophobic, obscene, abusive, defamatory, misleading, or fraudulent content or content containing other people’s personal details. Epassi has a right to edit or remove any content anytime without giving a reason to the edit or removal.

If a User suspects a rights violation regarding content, User is encouraged to report it through the Support form.

Confidentiality: The content (including the Promotions) of the SuperDeals Portal is strictly confidential. None of the information contained in the SuperDeals Portal may be disclosed to any third parties. You may not take any information out from the SuperDeals Portal, including but not limited to sharing the Promotions to third parties. The Promotions contained by the SuperDeals Portal is intended for the users only, and may not be used for the benefit of others.

Denial of service:

Epassi reserves the right to withdraw and/or deny, without prior notice, access to the service to a particular user, in the event of suspected or proven improper or fraudulent use of the service.

Account Termination:

Your account may be terminated for the following reasons:

• Of your own free will : you can request a voluntary account termination by sending an email to the following address support@epassi.com , expressing your wish to unsubscribe from the service. Once the user's termination request has been received, Epassi will proceed to unsubscribe the user from the service within fourteen (14) days. Please note that you must also promptly inform your employer about the termination of your SuperDeals Portal.
• Termination of your employment with the Company: given that the access to the SuperDeals Portal is linked to your belonging to the Company, if you cease to be part of it, your account will be terminated accordingly.
• Prolonged inactivity: when an account has registered no activity or usage for a period of more than two years. Prior notice will be sent and your account could then be automatically terminated.
• Termination by the Company: if for any reason the Company decides to terminate the contractual relationship with Epassi or the contract is terminated for other reasons set out in the contract.
• Epassi has the right to terminate this agreement with two (2) months’ notice period. Epassi also has the right to terminate the agreement immediately if you have materially breached these terms or use SuperDeals Portal for illegal or inappropriate activities.

Guarantee and Limitation of liability:

As-is and as-available: The Service is provided on an “as is” basis. Epassi cannot guarantee that this website and SuperDeals Portal will operate continuously, without interruptions or be error-free. Epassi explicitly denounces any liability for unavailability of the Service or errors contained within the Service.

If a Promotion does not work, please notify us. Promotions cannot be applied retroactively to any purchases.

All the information provided on the Promotions in the SuperDeals Portal are provided by third parties, and to the maximum extent permitted by applicable law, Epassi expressly excludes any liability for errors, including non-working offers, outdated links or incorrect text.

External links and third party content: SuperDeals Portal may include links to other external sites. These principally belong to the merchants and will appear by means of banners, ads, links or other types of content managed by third parties whereto Epassi may have limited control. Epassi assumes no responsibility whatsoever for any matter relating to these websites, nor does it guarantee that these links may be free of viruses or other elements that may cause damage to the user's computer systems or files.

Furthermore, Epassi does not assume any responsibility for the contents of websites that may provide links to its website or make reference to it or post opinions about the Epassi Website and which may mislead users of said website about the services provided by Epassi.

Limitation of the liability: If you have any basis for recovering damages (including breach of these User Terms), to the extent permitted by the applicable law, you agree that your exclusive remedy is to recover, from Epassi or any affiliates, resellers, distributors, service providers and vendors, direct damages up to an amount equal to the fee paid by you for the product or service in question.

Intellectual Property:

The names, images and logos identifying Epassi and brand names are the intellectual property rights (whether registered or unregistered) of Epassi, its related companies, merchants, partners or their licensors.

All website and SuperDeals Portal design, text, graphics, the selection and arrangement thereof, and all software compilations, underlying source code, software and all other material on this website is protected by copyright of Epassi.

Data Protection:

Any personal information provided by the user for the purpose of registering will be processed in accordance with Epassi's privacy policy. Please read this document carefully before registering on the Site.

Changes to the service and assignment of the agreement:

Epassi continuously develops SuperDeals Portal, and Epassi has the right to change these terms, the content of the SuperDeals Portal, and the requirements set for the devices intended for the use of the SuperDeals Portal. Epassi will notify you of significant changes either by a message to your mobile device, email, or a notice published in the application. Changes that do not increase your obligations or reduce your rights will take effect immediately. If a change increases your obligations or reduces your rights, the change will take effect no earlier than one month after the change notice or earlier only with your acceptance.

The agreement continues with the modified content unless you terminate your SuperDeals Portal agreement before the change takes effect. You have the right to terminate the agreement immediately as described in section “Account Termination” until the announced effective date of the changes.

Epassi has the right to assign this agreement and the rights and obligations based on it in whole or in part to a designated party. You do not have the right to assign this agreement to a third party.

Governing Law

This agreement is governed by Finnish law, excluding its conflict of law rules.

You can submit a dispute related to the use of the targeted payment instrument in the Epassi service to the Consumer Disputes Board for resolution, see http://www.kuluttajariita.fi. You can also file a lawsuit in the district court of your domicile in Finland or the Helsinki District Court. If you do not have a domicile in Finland, the jurisdiction is the Helsinki District Court.
